FARGO — Scores of people took part in a noon-hour protest in Fargo’s downtown and outside City Hall on Sunday, May 8, in support of keeping access to abortion legal.

Protesters chanted “Not your body, not your choice!” at the busy corner of Broadway and First Avenue North in downtown Fargo, holding up signs supporting the right to an abortion and women’s reproductive rights.

The “Defending ROE: Women’s Rights are Human Rights” participants also lined up outside the city’s Civic Memorial Auditorium and City Hall a couple blocks to the east.

A Facebook invitation to the protest reads:

"One's body is inviolable, subject to one's own will alone. The Supreme Court is likely to rule on Roe V Wade in June, that is why it’s very important to make our voices heard before then!” the invitation said. “Come out and demand the Supreme Court we have safe, and legal accessible abortion.”

The local protest and others that sprang up around the country follow the unauthorized release of a draft of a Supreme Court opinion that would end national protection for abortion and turn the decision back to individual states on whether abortion procedures should be legal.

The 1973 Roe v. Wade Supreme Court decision has for decades made abortion legal throughout the U.S. It was further bolstered by a 1992 opinion, Planned Parenthood v. Casey.

But the leaked draft opinion, authored by conservative Associate Justice Samuel Alito, strongly repudiates that right

“Roe was egregiously wrong from the start,” Alito wrote.

“We hold that Roe and Casey must be overruled,” Alito said in the draft opinion. “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”

Thirteen states, among them North Dakota and South Dakota, have trigger laws in place that would automatically ban abortion in the first and second trimesters of a pregnancy if Roe v. Wade is overturned.

Altogether, about half of the states are expected to enact significant restrictions or bans on abortion, most of them in the Midwest and the South.
